Legislative Proposal to Remove the Defence of Reasonable Punishment – March 2018

This is Children in Wales response to the Welsh Government’s consultation on legislative proposals to remove the defence of reasonable punishment in cases of child assault.

The consultation was held between January and April 2018. The Welsh Government committed to removing the legal defence of reasonable punishment in order to promote positive parenting and help safeguarding children.

Removing this defence makes is clear that smacking children in wrong and is not an appropriate way to manage their behaviour.

In our response to this consultation, we agreed that the proposals would help to protect children’s rights, and said that it should be backed up with strong messages and information about positive parenting. The new legislations should be clear and unambiguous.
