Legislation will not allow a Ban on Smacking, 22/1/08 [W]

The Legislative Competence Order (LCO) on Vulnerable Children is to be amended to ensure that it will not give the National Assembly for Wales the powers to ban smacking. There had been some discussions about whether or not the LCO would enable such a ban while scrutinising the proposed LCO in committee.  As the situation was unclear the UK Government asked the Welsh Assembly Government to redraft that part of the LCO to make it clear that it does not cover the issue.  In a letter dated 22 January 2008, Gwenda Thomas, Deputy Minister for Social Services explained that there were concerns that if it was not amended the whole of the LCO might be endangered and because of this the Welsh Assembly Government had agreed to amend it.
